We WILL contact a user’s IP if we find that the user has violated our website use policy regarding images and content. Copyright violations could result in your ISP shutting down your website. Copyright violators will be charged usage fees for any of our images or content found in any form, electronic or otherwise. Please read the Licensing/Use page for more information.
We take theft of our images and content very seriously. To avoid prosecution, please read this entire page and contact the artist or artist’s agent for permission to use artist’s work.
The Artist or her Agent will gladly discuss licensing agreement options for use of the Artist’s work for various products, projects, or organizations, so contact us at the email address listed in this Policy. Thank you for your consideration and respect of the Artist’s work and livelihood.
A. General Use
Permission request to use works created by Dawn Schmidt Ventimiglia of Eclectic Dawn Arts should be directed to: email@example.com – we will respond as soon as possible. Provided that you have received WRITTEN PERMISSION from the artist, non-compensatory (free, non-paid, not sold) use is limited to non-commercial or one-time-only educational purposes, provided that a credit line shall include the phrase: “Courtesy of Dawn Schmidt Ventimiglia, Eclectic Dawn Arts.” To use a different credit line, contact the artist. Uses by institutions should be limited to one-time educational purposes only, and must carry a credit line. Contact the artist for permission BEFORE using any images or content created by the artist.
B. USE OF ORIGINAL ART IMAGES OR CONTENT
1. Private and Educational One-Time Use
The original works are created by Dawn Schmidt Ventimiglia, who retains any and all copyrights for any and all use, and all rights are reserved. Permission to use these images in part or in their entirety for any purpose MUST be obtained from the artist before images are used. Credit lines for printed educational use of these images sholuld include the phrase: “Courtesy of Dawn Schmidt Ventimiglia, Eclectic Dawn Arts.”
2. Saleable Item Use
Reproduction of art work in ANY FORM with INTENT TO SELL must be approved in writing by the artist or artist’s agent or heirs who retain copyright. Contact firstname.lastname@example.org to inquire about permission to use ANY works, in part or in their entirety. Artist will be compensated per a legally binding agreement between purchaser of Saleable Item Use (Licensing) Agreement and the Artist.
a. Publication Illustrations
Where a work will be used for a book cover or inside illustration to accompany educational material or to aid in the sale of such material, approve must be obtained in writing fromt eh artist or artist’s agent or heirs who retain copyright to the works.
These situation are usually approved when the following requirements are met:
1) A nominal courtesy fee is paid
2) Copies of the final book or other item is supplied to the artist or heirs
3) Proof approval by the artist or heirs when possible
4) Credit line for the artist
5- One time use agreement is signed
6) Safe return of original transparency, prints, or digital files (if on an external drive).
b. Miscellaneous Saleable Items
When the art work in any form is used to aid in the sale of items or materials, approval must be obtained in writing from the artist, artist’s agent, or heirs who retain copyright. Examples include, but are not limited to: henna tattoos, permanent tattoos, murals, posters, prints, book covers, coffee mugs, t-shirts, puzzles, hats, greeting cards, magnets, postcards, or any other item produced for sale by any group or individual.
These situations are usually approved with the following requirements:
1) A licensing fee per item TBD through negotiation of both parties, or a sale in toto of image rights to the entity producing the items for sale
2) One or more item(s) or photos of item(s) on which the image is produced will be supplied to the artist or heirs
3) Proof approval by artist or heirs when applicable
4) Credit line for artist, whether or not rights have been transferred.
5) Specific use agreement in writing, signed by both parties
6) Safe return of original transparency, prints, or digital files
